‘Social gambling’ legal,
but many limits apply

A friend asked me to join his group in "social gambling." Is it legal? Who may participate in this type of activity?

All forms of gambling are illegal here, except social gambling.

And what constitutes social gambling, as found in the Hawaii penal code under "Offenses Against Public Health and Morals," is very specific, with all these conditions to be met:

Players have to be at least the age of majority (18) and compete on equal terms; no one can receive anything of value or any profit other than personal winnings; and no other person receives anything of value or any profit from any source, such as use of premises or from supplying food, drink, services, lodging, entertainment, etc.

Also, social gambling cannot be played in specific places, such as a hotel, motel, bar, nightclub, cocktail lounge, restaurant, massage parlor, billiard parlor OR any business establishment of any kind, and not in public parks, public buildings, public beaches, school grounds, churches or any other public area.
